A European Commission proposal which would have made it harder for insurers to use gender to assess premiums just failed to win backing on Monday.
But there are hopes the draft law, which needed approval from all 25 EC members, will be passed in December.
Germany abstained in a vote, saying it needed to check if the proposed law was compatible with its constitution.
Insurers had opposed the plan but are understood to be willing to accept the compromise nearly passed.
The compromise solution was negotiated with the insurance
